PPF Compensation Cap – Will Europe force a rethink?: A member has challenged the application of the PPF compensation cap and taken his case to the European Court of Justice. In a preliminary ruling, the Advocate General concluded that members should receive 50% of the value of their benefits. If the Court agrees with this opinion, it has the potentially far-reaching implications, not only for the PPF and the levy payer but also for schemes that may have wound-up outside of the PPF where members were subject to the cap.

Can Trustees take into account the PPF when making decisions?: A decision by the Upper Tribunal in the ITV plc vs TPR case (the ‘Box Clever’ case) has shown that Trustees need not ignore the existence of the PPF on every occasion although the situations where this is possible are quite restricted.
